Welcome to Zakaty. These Terms and Conditions govern your use of the Zakaty website at zakaty.ai and the services we provide through it, including our Zakat calculator, AI companion, charity discovery tools and donation services (together, the "Platform").

Please read these terms carefully before using the Platform. By accessing or using the Platform, you agree to be bound by them. If you do not agree with any part of these terms, please do not use the Platform.

These terms should be read alongside our Privacy Policy, which explains how we collect and use your personal data.

1. About us

2. What the Platform does

The Platform is designed to:

  • Help you estimate your Zakat obligations using our calculator
  • Provide general educational content about Zakat and Islamic giving
  • Answer questions through our AI companion
  • Help you discover UK-registered charities that accept Zakat
  • Enable you to make one-off or recurring donations to those charities

Zakaty is a facilitation platform. We connect donors with charities. We are not ourselves a charity, and we do not provide religious rulings (fatawa), regulated financial advice, legal advice or tax advice.

3. Who can use the Platform

You may browse the Platform and use the calculator freely. To create an account, make a donation, set up a Direct Debit or make a Gift Aid declaration, you must:

  • Be at least 18 years old
  • Be legally capable of entering into binding agreements
  • Use a payment method that you are authorised to use

4. Religious and financial guidance

Zakat is an act of worship (ibadah) and a personal religious obligation. Our calculator and educational content are based on commonly accepted scholarly principles, but Islamic jurisprudence contains legitimate differences of opinion between schools of thought (madhahib), and our content may not reflect every scholarly position.

This means:

  • All calculations and information are provided for guidance only
  • Final responsibility for calculating and paying your Zakat correctly rests with you
  • For specific rulings on your personal circumstances, you should consult a qualified Islamic scholar
  • For decisions about your finances, investments or tax affairs, you should consult an appropriately qualified professional adviser

5. AI-generated content

Our AI companion uses artificial intelligence to answer questions about Zakat and Islamic giving. AI-generated responses:

  • Are produced automatically and may contain errors, omissions or outdated information
  • Do not constitute religious rulings, financial advice or legal advice
  • Should be verified against authoritative sources before you rely on them for any significant decision

You must not attempt to misuse the AI companion, including by trying to make it produce harmful, unlawful or misleading content.

6. Your account

If you create an account, you are responsible for keeping your login details confidential and for all activity that takes place under your account. Please tell us promptly at support@zakaty.ai if you believe your account has been accessed without your authorisation.

You agree to provide accurate information when registering and to keep it up to date.

7. Donations and payments

7.1 How donations work

When you donate through the Platform, your payment is processed by [PAYMENT PROVIDER], a regulated third-party payment provider, and directed to your chosen charity. Zakaty does not hold your funds. By donating, you also agree to the payment provider's own terms of service.

7.2 Recurring donations and Direct Debits

You can set up recurring donations, including monthly payments by Direct Debit. Direct Debit payments are protected by the Direct Debit Guarantee, which entitles you to an immediate refund from your bank in the event of an error in the payment of your Direct Debit. You can cancel a Direct Debit at any time by contacting your bank, and we ask that you also notify us so we can update your giving plan.

You can pause, change or cancel recurring donations through your account or by contacting us. Changes take effect from the next scheduled payment where reasonably practicable.

7.3 Refunds and mistaken donations

Donations are gifts and are generally non-refundable once passed to the charity. If you make a donation in error (for example, an incorrect amount or duplicate payment), contact us as soon as possible at support@zakaty.ai and we will work with you, the payment provider and the charity to try to resolve it. Nothing in this section affects your rights under the Direct Debit Guarantee or your statutory rights.

8. Gift Aid

If you are a UK taxpayer, you may be able to add Gift Aid to your donations, allowing the charity to reclaim 25p for every £1 you give. When you make a Gift Aid declaration through the Platform, you confirm that:

  • You are a UK taxpayer
  • You will pay enough Income Tax and/or Capital Gains Tax in the relevant tax year to cover the Gift Aid claimed on all your donations to all charities in that year

If you pay less tax than the Gift Aid claimed, it is your responsibility to pay the difference to HMRC. Please tell us if your tax status changes or you want to cancel your declaration. Your declaration details are shared with the recipient charity and may be shared with HMRC, as described in our Privacy Policy.

9. Charity listings

We carry out reasonable checks before listing charities on the Platform, including verifying their registration with the Charity Commission for England and Wales or the equivalent regulator. However:

  • A listing is not an endorsement or recommendation by Zakaty
  • Each charity is responsible for its own Zakat policy, including how it interprets Zakat-eligibility and how it distributes funds
  • We are not responsible for how a charity uses your donation once it has been passed on

We encourage you to review a charity's own published information before donating, particularly if you have specific requirements about how your Zakat is distributed.

10. Acceptable use

When using the Platform, you agree to:

  • Provide accurate and truthful information
  • Use the Platform only for lawful purposes
  • Not attempt to disrupt, damage or gain unauthorised access to the Platform, its systems or other users' accounts
  • Not use the Platform for money laundering, fraud or any other unlawful financial activity
  • Not scrape, copy or reuse Platform content or data without our written permission

11. Intellectual property

All content on the Platform, including text, design, logos, calculators and software, is owned by or licensed to Zakaty, unless otherwise stated. Quranic verses and Hadith texts are reproduced for educational purposes with translations from their respective published sources.

You may view and print content for your personal, non-commercial use. You must not otherwise copy, reproduce, distribute or create derivative works from Platform content without our prior written permission.

12. Third-party links and services

The Platform contains links to third-party websites and relies on third-party services, including payment providers and the charities we list. We are not responsible for the content, accuracy, availability or privacy practices of third parties. Your use of third-party services is governed by their own terms.

13. Availability and accuracy

The Platform is provided on an "as is" and "as available" basis. We work hard to keep it accurate, secure and available, but we do not guarantee that:

  • The Platform will be uninterrupted, error-free or free from harmful components
  • Calculations, Nisab values or other content will always be complete or up to date

We may suspend, withdraw or change all or part of the Platform at any time, including for maintenance and updates.

14. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales. Nothing in these terms affects your statutory rights as a consumer.

Subject to the paragraph above, we are not liable for:

  • Loss arising from your reliance on calculations, AI-generated content or educational material, which are provided for guidance only
  • The acts or omissions of charities, payment providers or other third parties
  • Loss that was not a foreseeable result of our breach of these terms
  • Business losses, as the Platform is provided for personal, non-commercial use (business use of our B2B services is subject to separate terms)

15. Suspension and termination

We may suspend or close your account, or restrict your access to the Platform, if you breach these terms, if we reasonably suspect fraudulent or unlawful activity, or if we are required to do so by law. Where reasonable, we will give you notice and an opportunity to respond. You may close your account at any time by contacting us.

Termination does not affect donations already made or any Gift Aid declarations already submitted to HMRC.

16. Privacy and data protection

We take your privacy seriously. Our Privacy Policy explains what personal data we collect, how we use it, who we share it with (including charities and HMRC for Gift Aid purposes) and your rights under UK data protection law.

17. Changes to these terms

We may update these terms from time to time, for example to reflect changes in our services or in the law. We will post the updated terms on this page with a revised "last updated" date, and for significant changes we will take reasonable steps to notify registered users. Your continued use of the Platform after changes take effect constitutes acceptance of the updated terms.

18. General

If any part of these terms is found to be unenforceable, the remaining provisions will continue in full force. If we do not enforce a right under these terms, that does not mean we have waived it. These terms are between you and us, and no other person has rights to enforce them.

19. Governing law

These terms are governed by the law of England and Wales. Any dispute may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
